HSE has sent out a health warning following the discovery of high levels of legionella bacteria in a Liverpool hospital’s water supply system.

Liverpool Magistrates Court found the Liverpool Heart and Chest Hospital NHS Trust guilty of breaching Sections 2(1) and 3(1) of the Health and Safety at Work Act, 1974 by putting its employees and patients at high risk to the legionnaires’ disease. On October 8 2009, the Trust was ordered to pay 35,000 pounds as fine and costs of 12,862 pounds after it pleaded guilty to the charges.

The investigation conducted by HSE at the hospital concluded that there were significant traces of legionella in the water of its showers, sinks and baths. Two of its patients also died of legionnaires’ disease in early 2007. However, it is still not clear whether they had caught the disease at the hospital or somewhere else.

The NHS Trust was also heavily criticized for discontinuing the testing of its water even after an investigation of the Audrey Leigh wing in 2002 had revealed that there was high legionella concentration in the water.

Kevin Jones, a HSE inspector, said in this regard that it is not understandable why the hospital and its trust did not take the legionella contamination matter seriously and take adequate steps in this direction. He pointed out that the hospital was aware of the contamination and yet the authorities discontinued the tests, which put both patients and employees at risk.

Jones also said that since patients of the hospital were more vulnerable to the disease, the management should have been more proactive and should have taken up the task of eliminating the bacteria from the water supply system.

HSE severely criticized the management for failing to show concern for the safety of the patients and workers and exposing them to such high risks.
